Terms of Service (ToS)

These terms applies to all our existing users as of 2019-06-27, and any new users as of 2019-05-19.
These Terms of Service ("ToS") set forth the conditions under which 3NT Solutions LLP ("3NT") provides dedicated servers, VPS, cloud instances, and access to related interfaces (collectively, the "Service"). By using any Service, the Customer accepts these Terms in full and without reservation.

Use of any Service constitutes full agreement to this ToS.

1. Customer Eligibility & Responsibilities

1.1 Legal Capacity
Customer affirms they are not restricted by UK law or their local jurisdiction from entering into this contract unless approved by 3NT with verifiable documentation.
1.2 Registration & Account Security
Customer must register with valid, current information and maintain its accuracy in the Hostcare Panel. The Customer is solely responsible for:
  • Confidentiality of login credentials
  • Actions taken through their account
  • Security of used services
  • Reporting misuse or security breaches via support ticket
1.3 Content Responsibility
Customer is solely responsible for all content on their services and for acting upon any policy violations per the Acceptable Use Policy listed in Section 3 of this document.
1.4 Technical Competence
Customer must ensure they have the knowledge or resources to operate their services. 3NT is not liable for misconfigurations or resulting downtime.
1.5 Data Security
Customer is responsible for preserving their own data, even when using 3NT’s backup services, which are offered without warranty.
1.6 Breach of Terms
Violation of these terms may lead to immediate termination of access to the Service, at 3NT’s discretion.

2. Master Service Agreement (MSA)

2.1 Term & Renewal
This Agreement starts with the first subscribed service and continues until termination of the last. Services auto-renew unless terminated in writing 5 days prior to the next invoice due date.

2.2 Charges & Payment
  • All fees are due in the currency invoiced in the Hostcare portal
  • Charges apply at service creation, upgrade, renewal, or overage
  • Services require a positive balance; late payments may incur 1% monthly interest
  • Invoices can be generated on request monthly

2.3 Usage-Based Billing
  • Billed monthly based on consumption
  • Usage is rounded up per unit
  • Customer must track usage via Hostcare
2.3.1 Professional Services
System management or migrations are billed in 15-min intervals at current hourly rates, only if agreed in advance.

2.4 Service Suspension
Services may be suspended if:
  • Terms, laws, or policies are violated
  • Security breaches are suspected
  • Payment is overdue
  • Service poses liability risk
  • Law enforcement requires action
Reconnection fee: 3% of service cost (min. $25 or local equivalent).

2.5 Taxes & Fees
Customer is responsible for all taxes and must provide valid exemption documents if applicable.

2.6 Customer Duties
Customer must:
  • Maintain accurate records
  • Follow the Acceptable Use Policy (see Section 3)
  • Enforce internal security protocols and strong passwords
  • Report service issues promptly via support ticket
  • Maintain sufficient balance
  • Comply with export regulations and licensing
  • Follow all software and content usage agreements

2.7 Service Level Agreement (SLA)
2.7.1 Availability
Service is provided "as is" with reasonable efforts to maintain uptime and access to Hostcare.
2.7.2 SLA Exclusions
Customer-side issues or third-party actions are not eligible for SLA credit.
2.7.3 SLA Credits
Eligible failures may result in credits (not cash) applied to future bills. Request must be submitted within 7 days.
2.7.4 Sole Remedy
SLA credits are the Customer's only remedy for service-related issues.

2.8 Disclaimers & Limitation of Liability
Services are provided without warranties. 3NT’s total liability is limited to one month’s service fee. 3NT is not liable for indirect, incidental, or consequential damages.

2.9 Confidentiality
Customer agrees to protect 3NT’s confidential information, including technical and operational data.

2.10 Indemnification
Each party agrees to indemnify the other for third-party claims arising from negligence or misconduct.

2.11 Termination
Either party may terminate upon 30 days’ written notice for material breach. Immediate termination applies for legal violations or serious policy breaches.

2.12 Legal Compliance
3NT may suspend or terminate Services in response to legal actions or court orders and is not liable for disclosures made in such cases.

2.13 Survival
Provisions intended to survive termination will remain in effect.

2.14 Force Majeure
Neither party is liable for delays due to events beyond their control (e.g., natural disasters, war, power outages).

2.15 Jurisdiction & Service of Process
This agreement is governed by the laws of the United Kingdom. Customers consent to service of legal notices via email or certified mail. Hague Convention requirements are waived.

2.16 Final Provisions
This ToS, including referenced policies (AUP, Privacy Policy), constitutes the entire agreement. Modifications must be in writing and signed by both parties. If any part is deemed unenforceable, the rest remains in effect.

3. Acceptable Use Policy (AUP)

By using 3NT Services, you agree not to engage in any activity that is illegal, harmful, or interferes with the use of our network or systems. Prohibited activities include, but are not limited to:

3.1 Illegal Use
  • Hosting or distributing content in violation of applicable laws (e.g., copyright infringement, hate speech, fraud)
  • Use of services for phishing, spam, or malware distribution
  • Operating services in violation of international export laws or sanctions
3.2 Security Violations
  • Unauthorized access to or use of data, systems, or networks
  • Interference with service to any user, including denial-of-service attacks
  • Intentional distribution of viruses, trojans, or malicious code
3.3 Network Abuse
  • Port scanning or vulnerability testing without prior authorization
  • Use of open relays or open proxies
  • Excessive use of system resources that disrupts normal operations
  • IP spoofing or forging headers to mask the source of traffic
3.4 Email and Messaging Abuse
  • Sending unsolicited bulk email (spam)
  • Using misleading or forged headers in emails
  • Harvesting email addresses without consent
3.5 Content Restrictions
  • Child sexual abuse material (CSAM)
  • Content promoting violence, terrorism, or self-harm
  • Content that infringes on intellectual property rights
  • Hosting or distributing pornography involving persons under the age of 18 or bestiality
  • Promoting, selling, or distributing drugs, weapons, or counterfeit goods
  • Operating cryptocurrency mining, carding, phishing, or scamming operations
  • Providing anonymization or obfuscation services used to evade law enforcement (e.g., bulletproof hosting, botnets)
3.6 Consequences
Violations of this AUP may result in warnings, suspension, or immediate termination of services without notice. Serious violations may be reported to authorities. In cases of repeat abuse or critical violations, 3NT reserves the right to blacklist IP addresses, destroy data, and permanently block account access.
